TERMS AND CONDITIONS OF SERVICE

Thank you for choosing our local business. Attached you will find the contract for services. Please review the attached information regarding our service;

-we CANNOT guarantee clearing times as every storm is different. 

-Gavel and driveway aggregates will be displaced due to snow removal, by checking above you understand this risk.

- We will automatically dispatch when we deem necessary with a typical benchmark of 10cm or more snow. If you have any question as to when we might arrive check our Facebook page for updates.  While we try our best to accommodate your schedule and timelines, please be understanding that weather varies and certain conditions can slow our efforts. 

-We typically will wait until the end of snow event to commence clearing. 

- Sand and Salt are not included in plow costs, if salt or sand is required a surcharge will follow. 

- On major snow events with more than 30cm of snow please expect delays in clearing, as this type of storm will slow our equipment down. It is recommended for heavy storms that you park more closely to the road to ensure you can exit if you need to before we come, we will do our best to service all our customers in a timely and efficient manner. Per Plow driveways will be subject to a double plow charge on extreme weather events.   

- We will be clearing around 1 meter away from obstacles such as cars, garage doors etc. however our operators will us discretion when clearing with this distance.

- As we have a very busy schedule, we will not be able to wait for vehicles to be moved or return to clear a parking spot where vehicle was without surcharge. .

- it is recommended you clearly mark any obstacles such as well, walls, trailers and obstacles we could hit that may be partially or completely covered in snow. We are not responsible for property damage of hazards in the snow. 

-FLYERS which are buried in snow and jam our snow blowing equipment causing us to delays will result in 10$ surcharge per instance if you do not pick up your flyers please call to cancel their delivery.

TERMS AND CONDITIONS 

Client - as indicated in name field of form above. Contractor - Kingswood Snow Removal and related employees ,contractors. 

 

This agreement supersedes all previous agreements and any verbal commitments made prior to the date of this agreement. Contractor will exercise its best judgment based upon weather forecasts and existing conditions. Contractor will automatically deliver service when there are snowstorms of 10cm or above, or if conditions are determined to warrant clearing such as snow followed by ice storm.  Client is aware that weather conditions in the area may change rapidly and without notice. Changes in weather conditions are considered to be an “Act of God” and contract assumes no liability for “Acts of God." Customer agrees to allow contractor to decide if snow plowing is warranted. Contract shall be binding inure to the benefit of the parties and their heirs, executors. administrators and assigns. Hold Harmless Agreement: To the fullest extent permitted by law, Customer agrees to defend, pay on behalf of, indemnify, and hold harmless Contractor, associated businesses, its officials, employees and volunteers and others working on behalf of Contractor against any and all claims, demands, suits or loss, including all costs therewith, and for any damages asserted, claimed or recovered against or from the corporation, its elected officials, employees, volunteers or others working on behalf of Contractor, by reason of personal injury, including bodily injury and/or death and/or property damage, environmental cleanup, including the loss of use thereof, which arises out of or is in any way connected or associated with this contract. 

 

Contractor is not at fault or negligence when a winter storm delays, excuses in part, or excuses in whole performance of services. Contractor is not responsible for damaged caused by hitting items in service areas, marked or unmarked which are in full, or partially covered by snow.

 

Contractor is not responsible for the following: any damage to the driveway, lawns or property surface, structure or aggregates from snow removal, shovelling, or salting - this includes, chipping scratching, cracks, breaks. Any damage to structure resulting from loose items within the snow,  accident or injury or death related to snow or ice,  actual physical removal of snow from service address, A non-slippery surface IS NOT guaranteed and Customer indemnifies Contractor from all claims resulting from snow/ice. Client agrees to keep pets and children away from service area when clearing is taking place. Client understands the risks associated with snow clearing activities. The above terms and quotation is accepted and you are hereby authorized to proceed with the snow clearing at the service address.

By submitting this form I agree to the risks associated with snow clearing on the property listed.
